The Forest County Potawatomi Community Gaming Commission’s (FCPCGC) Employee portal is owned and operated by the FCPGC to provide you with information about our regulatory agency and to allow you to interact with us. You access and use of FCPCGC’s Employee portal is subject to the following Terms and Conditions and all applicable laws. By accessing and browsing FCPCGC’s Employee portal, you accept these Terms and Conditions in whole. If you do not agree with any of the Terms and Conditions below, do not use FCPCGC’s Employee portal. FCPCGC reserves the right, in its sole discretion, to modify, alter or otherwise update these Terms and Conditions at any time and you agree to be bound by such modifications, alterations or updates. All material on the FCPCGC Employee portal shall be considered confidential to FCPCGC and, in the case of material provided by third parties (e.g. benefits providers), to our business partners and/or vendors. This material should only be used for its intended purpose and shall not be disclosed outside of FCPCGC, except for third party material submitted to the applicable third party in accordance with its intended use, without the prior written authorization of FCPCGC.
All material on this site is protected by copyrights which are owned and controlled by the FCPCGC or by other parties that have licensed their material to FCPCGC. Material from FCPCGC’s Employee portal may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way.
FCPCGC restricts access to your personal information to those employees who need to know this information to provide services that you request. Although FCPCGC takes strict precautions to prevent unauthorized access to your personal information, we cannot guarantee that these precautions will prevent third parties from illegally accessing this information.
The trademarks, logos, and service marks that may be displayed on the FCPCGC Employee portal are the property of FCPCGC and other parties. Users are prohibited from using any marks without the written permission of FCPCGC or such third party which may own the mark. Any use of the Forest County Potawatomi Community logo shall at all times be subject to the FCPC Logo Usage Guidelines issued September 30, 2013, and as those guidelines may be updated from time to time.
This site is provided “as-is” and your use and browsing of FCPCGC’s Employee portal is done at your own risk. If you are dissatisfied with any of the materials contained in FCPCGC’s Employee portal, or with any of these Terms and Conditions, your sole and exclusive remedy is to discontinue accessing and using FCPCGC’s Employee portal.
TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER FCPCGC NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING FCPCGC’S EMPLOYEE PORTAL OR CONTENT IS LIABLE FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT, OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO, OR USE OF, FCPCGC’S EMPLOYEE PORTAL. FCPCGC’S EMPLOYEE PORTAL AND EVERYTHING ON FCPCGC’S EMPLOYEE PORTAL IS PROVIDED TO YOU “AS-IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
This Agreement will terminate immediately without notice from FCPCGC if in FCPCGC’s sole discretion you fail to comply with any term or provision of this Agreement. Upon termination, you must destroy all materials obtained from FCPCGC’s Employee portal and all copies thereof, whether made under the terms of this Agreement or otherwise. In the event of termination, the disclaimers and limitations of liabilities set forth in this Agreement shall survive.
Nothing in these Terms and Conditions or this Agreement shall be interpreted or construed as a waiver of the Forest County Potawatomi Community’s, or the FCPCGC’s, sovereign immunity from suit.
The FCPCGC Employee portal may in the future contain items like: bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendar, and/or other message or communication facilities designed to enable you to communicate with the public at large or with a group (collectively, “Communication Services”). You agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:
If Communication Services are offered, FCPCGC has no obligation to monitor the Communication Services. However, FCPCGC reserves the right to review materials posted to a Communication Service and to remove any objectionable materials, in its sole discretion. FCPCGC reserves the right to terminate your access to any or all of the Communication Services (or the Employee portal) at any time without notice for any reason whatsoever.
FCPCGC reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post to or remove any information or materials, in whole or in part, in FCPCGC’s sole discretion. Always use caution when giving out any personally identifying information about yourself or your children while using or in any Communication Service. FCPCGC Employee portal does not control or endorse the content, messages or information found in any Communication Service and specifically disclaims any liability with regard to the Communications Services and any actions resulting from your participation in any Communication Service.
FCPCGC does not claim ownership of the materials you provide to FCPCGC (including feedback and suggestions) or post, upload, input or submit to the Employee portal. However, by posting, uploading, inputting, providing or submitting such information you are granting FCPCGC permission to use your submissions in connection with the operation of the Employee portal, including, without limitation, the right to: copy, distribute, transmit, publicly display, publicly perform, edit, translate and reformat any of your submissions; and to publish your name in connection with your submission.
No compensation will be paid with respect to the use of your submission. FCPCGC is under no obligation to post or use any submission you may provide and may remove any submission at any time in FCPCGC’s sole discretion.
By posting, uploading, inputting, providing or submitting information to the Employee portal you warrant and represent that you won or otherwise control all of the rights to your submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the submissions.
